Remaining a South African Tax Resident After Moving, On Purpose

Almost everything written for South Africans moving to Canada assumes the goal is cutting the tax cord fast. Nobody talks about the people remaining a South African tax resident after moving on purpose, and there are more of them than the emigration content suggests.

A work-permit holder with a spouse and kids still in South Africa — a home still occupied, a clear plan to return in two or three years — is a different case from a family that’s sold up and applied for permanent residence. The tests are built to tell those two situations apart.

And worldwide income consequences of staying SA resident are real. SARS taxes South African tax residents on worldwide income, not just South African-source income. Canadian employment income earned during your assignment is, in principle, taxable in South Africa too, on top of whatever Canada withholds. The foreign tax credit concept for retained residency, broadly, is that tax already paid to Canada on the same income reduces what’s owed to SARS on it. Watch the drift from temporary into permanent.
