Your South African Tax Obligation Is Ceasing: Residency Rules on the Express Entry Timeline

An Express Entry file moves through fixed, mostly predictable stages — profile, invitation, submission, Confirmation of Permanent Residence, landing. Ceasing South African tax residency runs on an entirely different clock, one that doesn’t care what date is stamped on your COPR, and lining the two up badly is where the real cost of ceasing tax residency south africa timeline planning tends to show up.

Point one: which test actually ends your residency, and what it costs in time

SARS recognises three separate routes out of tax residency, and they cost you differently in waiting time. The ordinarily resident test looks at your intention plus objective facts — visa type, proof of foreign permanent residence, a foreign tax residence certificate, whether you still hold SA property or business interests, where your family lives, and how often you come back — and can, in principle, apply from an earlier date if the facts genuinely support it. The physical presence test is purely mechanical: you cease being resident once you’ve been continuously outside South Africa for at least 330 full days, which costs you nothing except patience. A double taxation agreement tie-breaker can end residency automatically if the treaty deems you exclusively resident elsewhere, but it needs a foreign tax residence certificate to support it — a document you generally can’t get instantly after landing.

Point two: the paperwork cost of declaring it

You declare your cessation date on the RAV01 form via SARS eFiling, under “Income Tax Liability Details.” SARS then opens a case and asks for a signed declaration, a motivation letter, a passport copy showing entry and exit stamps, plus whichever test-specific evidence applies to your route. SARS can, and does, decline declarations where the criteria aren’t met or documents are incomplete — so this isn’t a form you file once and forget; it’s a case SARS actively assesses before issuing a Notice of Non-Resident Tax Status.

Point three: the tax cost that catches people off guard

This is the one that actually costs money, not just time. Section 9H of the Income Tax Act treats residency cessation as a deemed disposal of your worldwide assets at market value, the day before residency ends — a notional sale, with no actual cash proceeds to pay the resulting tax from. Fixed property situated inside South Africa falls outside this deemed disposal and remains taxable here no matter where you’re resident. For individuals, the capital gains mechanics work out to a maximum effective rate of roughly 18% on the gain (a 40% inclusion rate at up to the 45% marginal rate), with an annual exclusion reported at R40,000 for 2025 — confirm the current-year figure with a tax practitioner before relying on it. After cessation, only SA-sourced income stays taxable here.

Where the immigration timeline and the tax timeline actually meet

The financial-transfer side depends on the tax side being settled first: an Authorised Dealer can only move larger sums abroad once you’ve proven cessation and obtained a SARS Tax Compliance Status confirming it. In other words, your Express Entry landing date and your tax-residency cessation date don’t have to match, but your ability to move meaningful money to Canada is gated by whichever one finishes last.

None of the tests, forms or rates above are advice about when you should cease residency — that decision has real tax consequences and belongs with a registered South African tax practitioner who can look at your full financial picture, not a general explainer. Cape2Canada’s moving-costs series lays out the sars cease tax residency process next to the immigration milestones, precisely so a ceasing tax residency south africa timeline doesn’t quietly outrun your Express Entry one.
